Lawyers defending a motel chain accused of eavesdropping on telephone calls were within their rights to contact motel employees about the allegations, a federal judge has ruled.
In a written opinion, U.S. District Judge Harry D. Leinenweber rejected the argument that a letter Sybaris Clubs International Inc.’s attorneys sent to employees requesting an interview was coercive and misleading.
In fact, Leinenweber wrote, that contention “fails to pass the straight-face test.”
